Terms of Service

1. Introduction

Welcome to Jallox's URL Shortener ("Service"). These Terms of Service ("Terms") govern your access to and use of the Service, including any associated websites, APIs, dashboards, and features.

By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, you must not use the Service.

2. Definitions

• Service — The URL shortening platform operated under the name "Jallox's URL Shortener," including its web interface, API, analytics features, and all related infrastructure.
• User / you — Any individual or entity that accesses or uses the Service.
• Account — A registered account created through GitHub or Google authentication, used to access the Service's features.
• Link — A shortened URL created through the Service that redirects to a destination URL specified by the User.
• Custom Domain — A domain that a User connects to the Service to serve shortened links under their own domain name.
• Subscription — A paid plan that provides access to additional features, higher usage limits, or both.
• Content — Any URLs, destination links, labels, or other data submitted by a User through the Service.

3. Eligibility

You must meet the following requirements to use the Service:

• You must have the legal capacity to enter into a binding contract in your jurisdiction.
• You must comply with all applicable local, national, and international laws and regulations when using the Service.
• You must be at least 16 years of age, or the minimum age required in your jurisdiction to agree to these Terms, whichever is higher.

4. Accounts

The Service uses GitHub and Google OAuth for authentication. By signing in, you authorize the Service to access your basic profile information as permitted by the respective OAuth provider.

You are responsible for:

• Maintaining the security of your account credentials and OAuth tokens.
• All activity that occurs under your account, whether or not you authorized it.
• Notifying us promptly if you become aware of any unauthorized use of your account.

The Service is not liable for any loss or damage arising from unauthorized use of your account.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Create Links that direct to malware, phishing pages, or other malicious content.
• Distribute spam, unsolicited bulk messages, or deceptive content through the Service.
• Use the Service for fraud, scamming, or any form of financial deception.
• Shorten URLs that facilitate or promote illegal activities.
• Infringe upon the intellectual property rights of any third party.
• Distribute or host software designed to damage, disrupt, or gain unauthorized access to systems.
• Circumvent rate limits, security features, or access controls of the Service or of third-party systems.
• Impersonate any person, entity, or brand, or misrepresent your affiliation with any party.
• Host or link to content that is harmful, abusive, hateful, or harassing.
• Engage in excessive automated or programmatic abuse of the Service, including automated link creation at scale without authorization.
• Resell or sublicense access to the Service without written permission.

We reserve the right to suspend or terminate accounts that violate this section, with or without prior notice, at our sole discretion.

6. User Content

You retain full ownership of all URLs and destination content you shorten through the Service ("User Content"). The Service does not claim any ownership over your Content.

By creating a Link, you represent and warrant that:

• You own or have the necessary rights and permissions to use and share the destination URL.
• Your Content does not violate these Terms or any applicable law.

We do not routinely monitor User Content, but we reserve the right to remove Links that violate these Terms or that we reasonably believe pose a risk to other users or third parties.

7. Custom Domains (BYOD)

If you connect a Custom Domain to the Service, the following additional terms apply:

• You must own or have the legal authority to use the domain you connect.
• You are solely responsible for configuring your DNS records (including CNAME records) and maintaining your domain registration.
• You are responsible for any costs associated with your domain registration and DNS provider.
• We may remove or disconnect Custom Domains that violate these Terms, that are associated with accounts in violation of these Terms, or that we reasonably determine to be harmful or misleading.
• We do not guarantee uninterrupted availability of SSL/TLS certificates for Custom Domains. Certificate provisioning and renewal are performed on a best-efforts basis.
• We do not guarantee DNS propagation speed, resolution availability, or the correctness of any DNS configuration on your end.

You indemnify and hold the Service harmless from any claim, loss, or liability arising from your use of a Custom Domain, including but not limited to disputes over domain ownership.

8. Subscription Plans

The Service currently offers the following plans:

Plan features, pricing, limits, and availability are subject to change at any time. We will make reasonable efforts to notify users of material changes. Continued use of the Service after a change takes effect constitutes acceptance of the updated terms.

Paid Subscriptions are billed in advance on a recurring basis. All fees are non-refundable unless required by applicable law. If you cancel a Subscription, you will retain access to paid features until the end of the current billing period.

9. Availability

The Service is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, error-free, or available at all times.

We may perform scheduled maintenance, apply updates, or experience unplanned outages that temporarily affect availability. We will make reasonable efforts to minimize disruption but are not liable for any downtime or degradation of service.

10. Intellectual Property

The Service, including its software, code, design, branding, logos, documentation, and all related intellectual property, is owned by Jallox's URL Shortener. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it as described herein.

You may not copy, modify, distribute, sell, lease, reverse-engineer, or create derivative works from any part of the Service without prior written permission.

11. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. The Privacy Policy is incorporated into these Terms by reference.

By using the Service, you consent to the collection and use of information as described in the Privacy Policy.

12. Analytics

The Service collects privacy-friendly analytics when Links are accessed. This includes, but is not limited to:

• Country and region (derived from IP address, with IP addresses hashed and not stored in raw form).
• Browser type and version.
• Operating system and device type.
• Referrer information.
• Language preferences.

The Service does not use tracking cookies, browser fingerprinting, or any form of persistent user tracking. Analytics data is collected solely for providing statistical insights to Link owners and for operational purposes.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Jallox's URL Shortener and its operators, affiliates, and contributors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages.
• Any loss of profits, revenue, data, or business opportunities.
• Any damages resulting from your use of or inability to use the Service.
• Any damages resulting from third-party services, Custom Domains, or destination URLs.
• Any damages resulting from unauthorized access to or alteration of your data or transmissions.

In no event shall our total aggregate liability exceed the greater of one hundred US dollars (USD $100.00) or the amount you paid to the Service in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Jallox's URL Shortener and its operators, affiliates, officers, and contributors from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the Service.
• Your violation of these Terms.
• Your Content, including any URLs you shorten or distribute through the Service.
• Your Custom Domain configuration and use.
• Your violation of any third-party rights, including intellectual property rights.

15. Termination

We reserve the right to suspend or terminate your access to the Service, at our sole discretion, at any time and without prior notice, including but not limited to situations where we believe you have:

• Violated any provision of these Terms.
• Engaged in activity that is harmful to the Service, other users, or third parties.
• Created Links or used Custom Domains in a manner that violates applicable law.

Upon termination:

• Your right to access and use the Service ceases immediately.
• We may delete your Links, analytics data, and Custom Domain configurations.
• We may retain data as required by law or for legitimate operational purposes.

You may also terminate your account at any time by contacting us or by using any account deletion features made available through the Service.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in the Service, applicable law, or our operational practices. When we make material changes, we will make reasonable efforts to notify users through the Service or by email.

Your continued use of the Service after any changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service.

17. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which the operator of the Service is established, without regard to its conflict-of-law provisions.

Any disputes arising out of or relating to these Terms or the Service shall be resolved in the courts of competent jurisdiction in the applicable jurisdiction, except where arbitration or another dispute resolution mechanism is required by applicable law.
